INTRODUCTION
Who are We? HTHM Operations LLC (referred to herein as “HTHM”, "we," "us," and/or "our") is a food preparation and delivery network made up of company-operated, franchised, and licensed food preparation and delivery businesses. We believe in transparency, and are committed to protecting the privacy and security of the Personal Information (as defined below) that we receive, collect, use, share, and otherwise process from individuals that use or access our Services (as defined below), or otherwise interact with us as part of our business operations (“you” or “your”).
How does this Policy apply? This Privacy Policy (the "Policy"), together with our Terms and Conditions, apply to this website https://hearttohomemeals.com/) (the "Site"), our mobile app (the “App”), and our interactions with you offline or over the phone related to our services or offerings (collectively with the “Site” and the “App”, the "Services"). Further, many food preparation and delivery services are owned and operated by franchisees operating under our logo or brand (each a “Franchisee”), who are independent business owners. Therefore, in some instances, they may independently determine the purposes and means of processing your Personal Information and use your Personal Information for their own legitimate interest and/or business purposes as defined under applicable data privacy laws and as described in their respective privacy policies. This Policy does not apply to our Franchisees or to their websites or business operations with which you interact with. What is “Personal Information”? “Personal Information” means information that can be used to identify you, directly or indirectly, alone or together with other information. This includes things such as your full name, contact information, email address, phone number, government IDs, login IDs and passwords, device IDs, certain cookie and network identifiers, other categories described below, and may include Sensitive Information to the extent you voluntarily share with us or include in the “Wellness and Dietary Information” category outlined below
“Sensitive Information” includes Social Security numbers, or other national identity numbers or documents; precise geolocation or other identifying information relating to individual’s specific locations or residential information that are considered private; or sensitive personal data as defined under applicable privacy laws, or other sensitive information, including health insurance information, medical information regarding medical history, treatment, mental or physical condition(s), or home security passwords or settings that you do not wish to make such information public.
We may de-identify, aggregate and/or anonymize your Personal Information by excluding and removing data components (such as your name, email address, or linkable tracking ID) through obfuscation, or through other means so that the resulting dataset is no longer personally identifiable to you (such resulting dataset is known as “Aggregated Data”). Such “Wellness and Dietary Information” includes wellness- and health-related information about your wellness and dietary information, dietary habits, dietary restrictions, body mass index (BMI), lifestyle, health history, alcohol and caffeine consumption, smoker history (if any), specific reasons for referring you to place orders with HTHM and/or its Franchisees, and similar types of data relating to physiological conditions to the extent necessary and irrelevant to the meals and other offerings that we prepare at your express request.
We process Wellness & Dietary Data to
(i) provide the Services and to tailor products and offerings per your interests and goals, including reporting and analytics, and other wellness-related services, and product recommendations offered or recommended by us or our partners;
(ii) honor our terms of use and contracts, and
(iii) manage our relationships with you, and keep records of our communications with you. |

Payment and Order Information |
When you place an order through our website, our third-party payment processor will collect your billing address, your credit card information (credit card number, name on card, security code, expiration date, and CVV); email address; and billing zip code. After submitting your Payment Information, our payment processor may share with us invoices or such other transactional documents that may contain your financial information. We do not store your Payment Information, but our payment processor may store your Payment Information for the purpose of facilitating payment of your recurring order. |

· Exercise or defend legal rights or claims for us and/or Franchisees, suppliers, and business partners;

· Manage Franchisee information, Franchisee performance reporting, related customer support, and/or exit processes to transfer customer information from one exiting Franchisee to another.

HOW LONG DO WE STORE YOUR PERSONAL INFORMATION?
We will retain your Personal Information for an appropriate period of time as needed to fulfill the purposes for which it was collected, to comply with our business requirements and legal obligations, to resolve disputes, to protect our assets, to provide our Services, to pursue legitimate business purposes, to enforce our agreements, and other business or commercial purposes to the extent provided in this Policy.

- Meta/Facebook Pixel. We use Facebook Pixel to customize and display advertisements only to Facebook users who have shown an interest in our Sites or who have specific characteristics (e.g., certain demographics or interests in certain topics or products determined by websites visited) that we submit to Facebook. The use of Facebook Pixel helps ensure that our advertisements are in line with the potential interests of users and do not have a nuisance effect.
